1. Introduction

These Terms and Conditions ("Terms") govern your use of the Megaeth Travel Tour website (the "Website") and the travel services provided by Megaeth Travel Tour ("we," "our," or "us"). By accessing our Website and using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or services.

We reserve the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes.

2. Definitions

In these Terms:

  • "Booking" means the booking of a Tour, or any other travel arrangements, made by you through our Website or directly with our agents.
  • "Booking Confirmation" means the confirmation of your Booking that we send to you after we have processed your Booking request and received all required payments.
  • "Deposit" means the amount specified as such in relation to a Tour, which is part of the Tour Fee payable by you to secure your Booking.
  • "Force Majeure Event" means any act, event or circumstance beyond our reasonable control which impacts our ability to perform our obligations under these Terms.
  • "Tour" means a package of travel, accommodation, and/or other services provided by us as specified in the Tour description.
  • "Tour Fee" means the total price of the Tour as specified in the Tour description or as otherwise notified to you.
  • "Traveler" or "you" means any person who makes a Booking or participates in a Tour.

3. Booking and Payment

3.1. Booking Process

To make a Booking, you must:

  1. Be at least 18 years of age;
  2. Provide accurate and complete information;
  3. Accept these Terms;
  4. Pay the required Deposit or full Tour Fee as specified.

A contract between you and us will only be formed when we send you a Booking Confirmation. We reserve the right to decline any booking at our discretion without providing a reason.

3.2. Payment Schedule

Unless otherwise specified in the Tour description:

  • A non-refundable Deposit of 20% of the Tour Fee is required at the time of Booking.
  • The remaining balance must be paid no later than 90 days before the Tour start date.
  • For Bookings made less than 90 days before the Tour start date, the full Tour Fee is payable at the time of Booking.
  • Failure to pay any amount by the due date may result in the cancellation of your Booking and forfeiture of any payments made.

3.3. Prices and Currency

All prices on our Website are quoted in US Dollars (USD) unless otherwise specified. We reserve the right to change prices at any time before your Booking is confirmed. After confirmation, we will only increase prices in the following circumstances:

  • Increases in transportation costs (including fuel);
  • Increases in taxes, fees, or charges imposed by third parties;
  • Exchange rate fluctuations.

If a price increase exceeds 8% of the Tour Fee, you may cancel your Booking and receive a full refund.

3.4. Booking Fees and Additional Charges

A booking fee of 3% will be added to all transactions. Additional charges may apply for special requests, changes to your Booking, or optional services. These will be clearly communicated to you before payment is required.

4. Your Responsibilities

4.1. Travel Documentation

You are responsible for ensuring that you have all necessary travel documentation, including:

  • Valid passport with at least 6 months validity beyond your return date;
  • Necessary visas or permits for all destinations on your itinerary;
  • Travel insurance coverage (as specified in section 5);
  • Vaccinations and health certificates as required by the destinations.

We will not be liable for any losses or expenses incurred due to your failure to obtain proper documentation.

4.2. Health and Fitness

You must ensure that you are in good physical and mental health before the Tour start date. You must disclose any pre-existing medical conditions, disabilities, or special requirements at the time of Booking. We reserve the right to request a medical certificate or additional information.

Each Tour has a specified physical activity level. You are responsible for ensuring that you are capable of participating in all activities described in the Tour itinerary. We reserve the right to exclude you from certain activities if we reasonably believe that your participation would pose a risk to your health or safety or to that of other Travelers.

4.3. Compliance with Laws and Regulations

You must comply with all applicable laws, regulations, and customs of the countries you visit during your Tour. You agree to follow all reasonable instructions given by our tour leaders, guides, or other representatives.

4.4. Respectful Behavior

You must conduct yourself in a manner that is respectful to other Travelers, local communities, and the environment. Disruptive, abusive, or inappropriate behavior may result in your removal from the Tour without refund.

5. Travel Insurance

Comprehensive travel insurance is mandatory for all Travelers on our Tours. Your insurance must cover at minimum:

  • Emergency medical expenses and repatriation;
  • Trip cancellation and curtailment;
  • Loss of baggage and personal effects;
  • Personal liability.

We recommend that your insurance also covers adventure activities included in your Tour. You must provide details of your insurance policy before the Tour start date. If you fail to obtain adequate insurance, we reserve the right to cancel your Booking without refund.

6. Changes and Cancellations

6.1. Changes by You

If you wish to make changes to your Booking after confirmation, we will make reasonable efforts to accommodate your request, subject to availability and the following conditions:

  • All change requests must be made in writing;
  • An administration fee of $150 per Booking will apply;
  • Additional costs incurred as a result of the change will be charged to you;
  • Changes made within 60 days of the Tour start date may be treated as a cancellation and rebooking, subject to our cancellation policy.

Name changes are permitted up to 30 days before the Tour start date, subject to an administration fee of $75 per person.

6.2. Cancellation by You

If you need to cancel your Booking, you must notify us in writing. The following cancellation fees will apply:

  • More than 90 days before Tour start date: Loss of Deposit
  • 60-89 days before Tour start date: 50% of Tour Fee
  • 30-59 days before Tour start date: 75% of Tour Fee
  • Less than 30 days before Tour start date or no-show: 100% of Tour Fee

We strongly recommend that you purchase travel insurance that includes cancellation coverage to protect against these fees in the event of unexpected circumstances.

6.3. Changes by Us

While we make every effort to operate Tours as advertised, we reserve the right to make changes to Tour itineraries, accommodations, transportation, or other aspects of the Tour if necessary due to circumstances beyond our control or for operational reasons.

  • Minor Changes: We will inform you of any minor changes, but such changes will not entitle you to a refund or compensation.
  • Significant Changes: If we make a significant change to your Tour (e.g., change of destination, significant change to itinerary), we will inform you as soon as reasonably possible. You will have the option to:
    • Accept the change;
    • Accept an alternative Tour of comparable standard and price (if available); or
    • Cancel your Booking and receive a full refund of all amounts paid.

6.4. Cancellation by Us

We reserve the right to cancel a Tour in the following circumstances:

  • If the minimum number of participants required for the Tour is not reached (we will notify you at least 30 days before the Tour start date);
  • If we are prevented from operating the Tour due to a Force Majeure Event;
  • If we believe that operating the Tour would pose a risk to your safety or that of our staff.

In the event of cancellation by us for reasons other than a Force Majeure Event, you will be offered either:

  • An alternative Tour of comparable standard and price (if available); or
  • A full refund of all amounts paid.

We will not be liable for any additional costs incurred by you as a result of our cancellation, such as flights, visa fees, or other travel arrangements not booked through us.

7. Force Majeure

We will not be liable for any failure to perform our obligations under these Terms that is due to a Force Majeure Event. Force Majeure Events include but are not limited to:

  • Natural disasters, adverse weather conditions, or environmental events;
  • Acts of terrorism, war, civil unrest, or security threats;
  • Government actions, border closures, or travel restrictions;
  • Public health emergencies, epidemics, or pandemics;
  • Industrial action, strikes, or labor disputes;
  • Significant transportation disruptions or failures;
  • Any other circumstances beyond our reasonable control.

If a Force Majeure Event occurs before your Tour starts and significantly affects your Tour, we will offer you the choice of:

  • Postponing your Tour to a later date;
  • Accepting an alternative Tour (with a refund of any price difference if the alternative is of lower value); or
  • Receiving a credit voucher valid for 24 months or a refund of all recoverable costs (less a reasonable administration fee not exceeding 10% of the Tour Fee).

If a Force Majeure Event occurs during your Tour, we will make reasonable efforts to continue the Tour with suitable modifications, or to arrange your return transportation if continuation is not possible. Additional costs may be incurred and shared between us and you on a reasonable basis.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability to you for all claims arising from or in connection with these Terms or your Tour shall not exceed the total Tour Fee paid by you.
  • We are not liable for any indirect, special, incidental, or consequential damages, including loss of profits, revenue, data, or use.
  • We are not liable for any acts or omissions of third-party suppliers or service providers, including airlines, hotels, transportation providers, activity operators, restaurants, or other entities providing services in connection with your Tour.
  • We are not liable for any personal injury, property damage, or other loss that you may suffer during activities that involve inherent risks, such as adventure sports, hiking, swimming, or other physical activities.
  • We are not liable for any loss, damage, delay, inconvenience, or direct or consequential loss arising from the use of any vehicle, boat, aircraft, or other means of transportation, accommodation facilities, or other services.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any liability that cannot be excluded or limited by law.

9. Complaints and Claims

If you have a complaint during your Tour, you must inform our tour leader, guide, or local representative immediately, so that they can attempt to resolve the issue. If the issue is not resolved to your satisfaction, you must notify us in writing within 28 days of the end of your Tour, providing all relevant information and documentation. We will make reasonable efforts to investigate and respond to your complaint within 28 days of receipt.

We will not accept liability for any claims not notified to us in accordance with this section, or for any claims where you have failed to mitigate your loss.

10. Your Financial Protection

In accordance with the Package Travel and Linked Travel Arrangements Regulations 2018, all monies paid to us by you are fully protected. We maintain appropriate financial protection through bonding arrangements with [Financial Protection Body], which ensures that in the event of our insolvency, you will receive a refund of any money you have paid to us for an undelivered package or repatriation where applicable.

11. Privacy and Data Protection

We collect and process your personal information in accordance with our Privacy Policy, which is available at privacy-policy.html. By agreeing to these Terms, you acknowledge that you have read and understood our Privacy Policy.

12. Intellectual Property

All content on our Website, including text, graphics, logos, images, audio clips, digital downloads, and software, is our property or that of our content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works from any content from our Website without our express written permission.

13. Website Use

You agree to use our Website only for lawful purposes and in a manner that does not infringe the rights of any third party. You are prohibited from:

  • Using our Website in any way that could damage, disable, overburden, or impair our servers or networks;
  • Attempting to gain unauthorized access to any part of our Website, other accounts, or computer systems;
  • Harvesting or collecting user information without their consent;
  • Using our Website to transmit any malicious code, spam, or other material that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

We reserve the right to terminate your access to our Website if you violate these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or in connection with these Terms or your Tour shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in your home country in accordance with applicable consumer protection laws.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Booking Confirmation, and any other written agreement between you and us, constitute the entire agreement between you and us regarding your Tour and use of our Website, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
